【Notice】Mandatory Reporting of Possible Sexual Misconduct

【Notice】Reporting Campus Sexual Assault, Sexual Harassment, and Sexual Bullying  shall be made within 24 hours. All faculty and staff shall turn over the case to Gender Equity Education Committee for investigation and handling. Any other means of investigation or handling is NOT permitted.

Dear Faculty and Staff,
To promote gender equality and build a safe and harmonious campus, when faculty, staff, or janitors of the University become aware of a possible incident of sexual assault, sexual harassment, or sexual bullying on campus, he/she is obliged to notify the University within 24 hours in accordance with Paragraph 1 of Article 22 of Gender Equity Education Act. Violators would be fined from NTD 30,000 to NTD 150,000 based on Article 43 of Gender Equity Education Act. Therefore, if you become aware of any of the following situations, please report it to the Gender Equity Committee or the Campus Security Center as soon as possible. If the deadline is approaching (less than 3 hours remaining), you may report directly to the Military Education Section for campus security reporting to avoid penalties.
A. Sexual assault : acts constituting criminal sexual assault as defined in the Sexual Assault Crime Prevention Act.

§3
one of the following criteria but not constituting sexual assault:
  • Engaging in unwelcome sex- or gender-related speech or behavior, whether explicit or implied, which adversely affect the other party's personal dignity, learning, or work opportunities or performance.
  • Sex- or gender-related behavior that serves as the condition for oneself or others to gain or lose rights or interests in learning or work.
Gender Equality in Employment Act
§12
one of the following two circumstances:
  • In the course of an employee executing his or her duties, any one makes a sexual request, uses verbal or physical conduct of a sexual nature or with an intent of gender discrimination, causes him or her a hostile, intimidating and offensive working environment leading to infringe on or interfere with his or her personal dignity, physical liberty or affects his or her job performance.
  • An employer explicitly or implicitly makes a sexual request toward an employee or an applicant, uses verbal or physical conduct of a sexual nature or with an intent of gender discrimination as an exchange for the establishment, continuance, modification of a labor contract or as a condition to his or her placement, assignment, compensation, evaluation, promotion, demotion, award and discipline.
Sexual Harassment Prevention Act
§2
Excluding sexual assault crimes, the sexual harassment referred to herein means the sexual or gender-related behavior against the will of a male or female and meeting any of the following circumstances:
  • Impair another person’s dignity and personality, or create a situation that causes another person to feel scared, hostile or offensive, or improperly affect another person’s work, education, training, services, plans, activities or routine life, expressly or implicitly, by discriminatory or insulting language and conduct, or in any other manners; and
  • Allow oneself or another person to provoke, lose or impair the interest and right related to learning, work, training, service, plan and activity on condition that another obeys or reject the behavior.
 
C. Sexual bullying : ridicule, attacks, or threats directed at another person’s gender characteristics, gender temperaments, sexual orientation, or gender identity by using verbal, physical or other forms of violence will be under the category of sexual bullying not sexual harassment.
